Company Taken Over

Effective November 3, 2010 Menu Foods Income Fund was acquired by Simmons Pet Food, Inc. ("Simmons Pet Food"), an affiliate of Simmons Foods, Inc. As a result of the transaction, trading of the units of the Fund will be halted on the TSX, and then the units will be redeemed on November 4, 2010 at which time the redemption proceeds of $4.80 per unit will be paid to unitholders.
